Steroid Use in Major League Baseball Essay - 1272 Words

Steroid Use in Major League Baseball Why Major League Baseball players would use steroids is the biggest question that every person in the world wants to know. I think MLB players use steroids so they can bulk up and get stronger, which will allow them to last through the long, seven-month season. I think that because they play 162 games a year during these seven months that this causes a great deal of wear and tear on their bodies. Especially if a player gets hurt, they might try to take illegal medicines, such as steroids, to help them get back on the field quicker, hoping that maybe they could help their team win the pennant. Steroids however, are indeed very dangerous because they mess with the body’s hormones.†¦show more content†¦Everyone who he named was playing good baseball at the time he said they were taking steroids. For example, Mark McGwire was one baseball player’s name that came up. He broke the record for home runs in a season in 1998. It seemed impossible to break that record a t the time, but he did it. Now nobody knows if he was on steroids or not. When he had to come in front of a court recently, and they asked him questions about doing steroids, he said that he could not say not because his lawyer advised him not to and that it might hurt him and his family in the long run. When he did not answer the question, I myself lost respect for him because, to me, that meant he did indeed do steroids. He was the only player that did not answer the question. Sammy Sosa and Rafael Palmerio answered that they did not do steroids. Canseco also said that he not only injected McGwire, but also Jason Giambi. Giambi was the most obvious steroid user, and he actually admitted to doing steroids this year in front of a grand jury. If steroids were allowed in the MLB, there would probably be all kinds of new records, but this would not accomplish much because they were broken with the help of steroids. In Major League baseball this off-season, there has been a lot of controversy about steroids. The commissioner of MLB, Bud Selig, has banned steroid usage from the game. Polycoms Acquisition Process †Free Assignment Sample Available

Question: Discuss about the Polycoms Acquisition Process. Answer: Introduction In the given case we are dealing with two companies, PictureTel and PolyCom, they are in the business of Audio-Video conferencing. PolyCom has a share of 90% in audio conferencing and it is leading in the video conferencing market. PictureTel once had a huge market share which is declining currently. Moreover they are going through a loss $ 107 million in the year 2000. In the given case we have to follow the various process of PolyCom, which they consider while doing any acquisition. We are provided with the Income statement of PolyCom and PictureTel, and thei market share in Video Conferencing Products. Since PictureTel just launched another product IPower which is a substitute of a product launched by PolyCom. It is being seen that IPower might have a better market future than t he one launched by PolyCom. Due to lack in engineers and Research and development team of PolyCom they are considering acquisition. We have to decide whether acquisition of PictureTel is better option for PolyCom or not. We have to perfom Screening Test, Sensitivity Analysis, Net Present Value etc. We have to also consider other various factors such antitrust issue, lawsuits against PictureTel, and Integration of both companies after acquisition. Analysis: Whether to Acquire or do an inbuilt Video Conferencing Product: Polycom is the company which has a market share of 71%, currently they are selling ViewStation product line which has a market share of 54%. ViewStatiuon product of Polycom deals with prototypical appliance, they want to enter into something major i.e. IPower of PictureTell, which is more technologically advanced and has a better future along with good market share for personal video conferencing. Their first concern is whether they can make such product or should they outsource their manufacturing (by acquisition of manufacturing company). If we go through the 4 acquisition, we get to see that Polycom has always acquired companies who manufactures product for them and they provide their brand name, marketing help to excel the market. Name of the company acquired Product produced by them Reason ViaVideo Communication Inc Video conferencing equipment Since ViaVedion was in product development stage, it was reasonable to acquire it rather than in house production of video conferencing product. Atlas Communication Engines, Inc Integrated Access device Technology Atlas Communication was again not a big firm, and it was still dealing with their Research development phase. Polycom again considered purchasing the small firm. Circa Communication Voice-over-IP technology Prodcut Many companies already started to built Voice-Over-IP, if PolyCom started to built such product, it would had been a very late launch of product, as most of the companies would have already secured their market place. So they acquired Circa Communication and financially helped them to get through the stage of production. Accord Networks Network System They didnt have the core competencies and engineering expertise in that area. So they acquired the company with 50% market share instead of making it on their own. In the given case Polycom neither have engineers within depth expertise in video conferencing technology, nor research and development team, and ViaVedio is not capable of making such product. Polycom lack such feature hence they are considering of acquiring PictureTell for such benefits and increasing their market share. Since PictureTell is financially declining, Polycom is considering acquiring it for future benefit. Whether to Acquire PictureTel or not? Applying Screening Criteria: PolyCom considers only those deals which help to maintain or enhance its target operating model. Acquisitions needed to fill either a technology or product gap for PolyCom and good cultural fit also needed to exist between the two companies. And also, the company needs to pass the small test no potentially costly lawsuits, no hint of financial impropriety. For considering PictureTel, we have to first see whether it fulfills the target operating model. Growth rate of PictureTel can be calculated from Exhibit 8 and Exhibit 1b: We have to apply compound Growth rate formula to calculate growth rate of PictureTel, Formula of compound annual growth rate is, CAGR = (Ending Value / Beginning Value) ^ (1 / Number of years) 1 = (530 / 44) ^ 1 / 4 - 1 = 86.30% per year market growth Therefore, Growth of PictureTel would be, 16% (Exhibit 1b) of 86.30% i.e. 13.80% Estimated increase in Financial Statement of PictureTelupto 2005 would be as follows: Assumptions for the below calculations: Cogs increase as a percentage of total revenue SGA and RD cost remains similar to previous year Particulars 2001 2002 2003 2004 2005 Revenue: Product Revenue (174071*1.1380) 225429.6 256539 291941 332229 198093 Service Revenue (71078*1.1380) 92049.14 104752 119207 135658 80887 Total Revenue 278980 317479 361291 411149 467887 Cost of Goods Sold: Product cost of Revenue (128252*1.1380) 166092 189013 215096 244780 145950 Service Cost of Revenue (59945*1.1380) 77631 88345 100536 114410 68217 Total COGS 214167 243723 277357 315633 359190 Gross Margin 64813 73755 83934 95516 108698 Operating Expense: SGA Exp 65000 65000 65000 65000 65000 RD 47000 47000 47000 47000 47000 Total Operating Expense: 112000 112000 112000 112000 112000 Loss from Operations: -47187 -38245 -28066 -16484 -3302 Checking for operating model Assumptions: If PictureTel is acquired by PolyCom they will lay off 50% of the Employee, so their SGA expenditure will reduce by 50% of the current expenditure. COGS, sales and marketing costs are calculated as a percentage of Revenue. RD cost remains similar to previous year. Inference from above table: Although operating model criteria doesnt get met in the first year, it will eventually start getting met from 2002. However the model doesnt take into account the anti synergy cost arising due to Ipower eating into the revenue of Polycoms earlier product. PictureTel is providing technology as well as providing a new product, IPower to deal with the market. Since one of the founder of Polycom Brian Hinman, was also the founder of PictureTel, along with Jeff Rodman being the 5th employee of PictureTel. Since they used to work in PictureTel, PictureTel will not have much problem with cultural Fit factor, since the work ethics and some the policy will be similar to PictureTel. The company, PictureTel made various changes in their financial statement quarterly in the past, and during one of those changes it received a lawsuit from Securities and Exchange Commission of $ 12 million, which is quite a big amount. They may in future be able to again continue the same behavior of changing their Financial Statement which might cause them a law suit from the SEC. For that Polycom has to take over their accounts and other financial department totally. Calculation of NPV: Since the Value of operation is already negative, calculation of NPV is of no use. If we see the estimated cash flow pattern, we get to see that the loss of PictureTel is decreasing each year. If Polycom invest in PictureTel, it might turn into a profiting company within time. Sensitivity Analysis: If we consider doing Sensitivity Analysis, we have to consider changing the growth rate of PictureTel, but even if we increase the growth rate, the estimated cash flow will still be negative, as the Cost of Goods sold will also increase with the same growth. If the Cost of Goods sold and Operating Expense increases at a decreasing rate or a rate different from the rate of growth, then it might give a positive cash flow. Those cash flows might not be higher, but positive enough for a better future. Integration of companies Since the founder of the company PolyCom, Brian Hinman and Jeff Rodman were also the founder and employee of PictureTel, they will not have much problem regarding cultural fit of the integration. But since the previous acquisitions of PolyCom has always been of those companies whose number of employees generally ranged from 20 180 employees. And the number of employees of PolyCom itself is 537 which is less than the employees of PictureTel i.e. 820. PolyCom will have to do some huge number of redundancy, as they only require their after sales service staff, engineers and research development employees. They might have to curtail 50% of the employee or more to make the integration work. Generally during such acquisition, employees of the company which is being acquired are more scared about their status of job. If the company which is acquiring are clear from the beginning about their strategy, number of employees that will be curtailed then it will help the acquiring in integration. If they acquire PictureTel, then it will require a very carefull planning of integration, and it cannot be rushed upon as PolyCom did with their other such acquisition. If they acquire PictureTel, they will have a problem with antitrust issues which will be time consuming and costly. Already PolyCom is paying a huge consideration for acquiring PictureTel, with loan and cost for anti-trust issues their expense is only increasing. They should either re consider their consideration or come up with a better way to acquire the benefit of PictureTel. Conclusion From the above analysis we get to see various results, we were to decide whether acquisition of PictureTel by Polycom would have been a better decision or not. We first checked whether Polycom is capable of making the video conferencing product on its own or they need to buy it from outsiders and then sell it in the market with their own brand name and advertising technique. Since Polycom lacks better engineers and good research and development team, they are bound to get the product manufactured from outsiders. Hence, it is then decided that we should acquire a company whose engineers and Research development are better than the one of Polycom. PictureTel is in perfect position to be acquired, and since it has the requisite engineers and RD team plus they have the best after sales service facilities which Polycom lacks. Along with these benefits they can also have a huge market share, which will make them the ultimate seller of Audio-video conferencing products. From the above analysis which Polycom generally use to determine whether they should acquire a company or not, we concluded that acquiring PictureTel would be a better option for future benefit. The only struggle Polycom will face will be due to antitrust issued. For that we can make sure that Polycam doesnt acquire PictureTel immediately, when the financial position of PictureTel improves a bit, then they should acquire it, so that in future they can cover up the expense of antitrust issues. We considered screening test, sensitivity analysis, Net Present value and integration problems that we will face during such acquisition. We prepared the estimated Cash flow of PictureTel from which we get to see that the loss of picture tell is reducing gradually and it will turn into profit if Polycom provide its brand name and advertising facilities. Currently they should provide a loan of $15 million to PictureTel. From all that we finally concluded that acquisition is better option.

Explain the dramatic significance of Act 3, Scene 1. Essay Example

Explain the dramatic significance of Act 3, Scene 1. Essay Romeo and Juliet is a play about two star-crossed lovers from Verona both from two different families but it isnt as simple as that, the two families hold an ancient feud against each other. The prologue tells us quite a bit about whats going to happen during the play. It tells us that two star-crossed lovers will take their life A pair of star-crossed lovers take their life, and also that when they are dead their parents will end their family grudge, Doth with their death bury their parents strife. The two families, the Capulets and the Montagues, are enemies of each other throughout the play because of this ancient family feud they have numerous fights about this throughout the play. This particular play is a tragedy because the two main characters do die during the play. During the first two Acts, quite a lot happens as Romeo and Juliet meet at a masked ball and then realise that they are worst enemies, My only love sprung from my only hate. They fall in love almost instantly and arrange to meet up and get married. They were both ready to give up their family name for each other, Deny thy father and refuse thy name. Or if thou wilt not be but sworn my love. And Ill no longer be a Capulet. Act three provides a turning point in the play because if Romeo hadnt have been banished for killing Tybalt then Juliet wouldnt have had to fake her death to see him and keep out of marrying Paris then none of them would have died. In this scene, Romeo is banished causing dramatic effects on the rest of the play and resulting in Romeo and Juliet both killing them selves at the end of the play. In addition, we lose two other characters during this scene both during a fight over both the families as a result Mercutio and Tybalt are tragically killed Mercutio by Tybalt and Tybalt by Romeo. Therefore, by the end of this scene both Mercutio and Tybalt are both killed and Romeo has been banished from Verona. At the beginning of the scene it is a very hot day in Verona and everyone is hot and on edge. Benvolio is saying to Mercutio that they should leave because if they were to meet up with the Capulets then they shall not escape a fight And if we meet we shall not scape a brawl, for now these hot days, is the mad blood stirring. However, Mercutio is always ready to be angry and always up for a fight so he really isnt bothered. When Tybalt arrives, Benvolio seems angry that he hasnt escaped them because of Mercutio arguing with him over fighting, By my head, here comes the Capulets. But Mercutios reaction is totally the opposite of Benvolios he doesnt seem to care that Tybalt has arrived By my heel, i care not. He also takes the fun out of Benvolio by saying that meaning also he shall not move. Mercutio provokes the situation by saying that if he wants a word he can have a fight aswell And but one word with one of us? Couple it with something make it a word and a blow. At this point in th e play it relates back to the beginning of the play where many fights go on and the prince Escalus threatens them with severe penalties. At this point in the play, the audience will feel quite scared for the characters because if they do break out into a fight then the severe penalties will be brought in and something will happen to one or more of the characters. When Tybalt sees Romeo approaching, he says to Mercutio, here comes my man. Tybalt wanted a word with Romeo. When Romeo arrives, he says to Romeo that he cant say anything more positive about him than that he is a villain. The reason that i have to love thee doth much excuse the appertaining rage to such a greeting. Romeo was saying that he has to love him for Juliet. When Tybalt challenges Romeo to a fight, Romeo backs away, I do protest I never injured thee, But love thee better than thou canst devise Till thou shalt know the reason of my love. And so, good Capulet, which name i tender as dearly as mine own, be satisfied. Here Romeo was saying to Tybalt that no he wont fight him and he will never guess the reason why he loves him so dearly, then he tries to stay out of it. Mercutio seems shocked by the way Romeo acts towards Tybalt and then challenges Tybalt to a fight Tybalt, you rat-catcher, will you walk? During the beginning of the play Tybalt is portrayed as an aggressive person because of the way he acted at the masked ball when he recognized the Montagues, and it nearly broke out into a fight but Lord Capulet insisted they shouldnt. Later in the play, he is killed by Romeo because Tybalt killed Mercutio Romeos friend. Tybalt seems like a fighter and not a talker because as soon as he sees the enemy he is ready to fight. When Tybalt and Mercutio had that fight Tybalt didnt really want to fight him but Mercutio pushed him into it Tybalt you rat-catcher, will you walk? Tybalt is just loyal to his family and will do anything for them but also he can be a villain. Mercutio is dashing and very popular and on the Montagues side but not by blood he is Romeos friend, we find out that he can be quite a joker too. When Mercutio and Tybalt start to fight Romeo pleads with Benvolio to stop them Draw Benvolio; beat down their weapons. Then Romeo ends up in the middle of them; the audience must feel very worried that Romeo may be killed at this point but luckily, he doesnt. However, Mercutio does get hurt and is lying on the floor and says, didnt Tybalt get hurt but no he didnt he ran off with his men straight after so that he wouldnt be caught by the prince. As Mercutio is hurt he calls Romeo a villain and tells him to get a surgeon. Mercutios cut only looked like a scratch but it was very deep and painful so as a result he passed away. As Mercutio is not a Capulet neither a Montague before he dies he curses both families both the Capulets and the Montagues A plague, o both your houses! Some theorists believe that Mercutio was killed off in this scene because he was too vibrant a character and they believed that he would divert the audiences attention off Romeo and Juliet i do agree with this as Mercutio is always about and always part of most things. Mercutio is involved in numerous scenes he was involved in most of the fights and also he was involved with the ball, Mercutio is also mostly around when Benvolio is around to fill the gaps between the fights and the loves scenes. At the beginning of the play, Romeo is a very quiet character and very upset because Rosaline doesnt return his love he feels for her. He felt very strongly about the feud at the beginning of the play as he hated the Capulets. When he met Juliet, he seemed to be a lot happier and when he found out that Juliet was a Capulet he was shocked but felt differently towards them instead of hating them so much. When Romeo finds out that Mercutio is dead Tybalt turns up and he gets so angry he kills Tybalt. Romeo could have prevented at least one death by not going to kill Tybalt because that is the turning point in the play where most things start to go wrong because as a result he gets banished by the prince witch leads to more complications.O, i am fortunes fool. Here Romeo is saying that fate was playing around with him. In Shakespeares time people were great believers in fate because at this time people believed in witchcraft and myths. Benvolios function in this scene is to be there to try get Mercutio out of the street and warn the audience that a fight is about to break out by warning Mercutio. He is also there to help Mercutio after he has been stabbed and to inform Romeo of Mercutios death. Then after this Benvolio is not needed no more because Romeo has been banished so he is not there for him and so not needed. In addition, Benvolio doesnt know about Juliet so he cant be part of the rest as there is no need. When the Prince and the Montagues and Capulets arrive on the scene, the prince asks what was going on. Benvolio tries to cover Romeo as best as he can but it doesnt work therefore the prince punishes him by banishing him from Verona. As Romeo is banished, he cannot see Juliet as he cant step foot inside of Verona. In conclusion, i think that this scene turns the play around and it does cause the death of Romeo and Juliet. Both Romeo and Juliet end up committing suicide because since Romeo is banished they send him a letter but only the letter never gets there so when he finds out Juliet is dead he goes back to see her and kills himself. When Juliet wakes up she sees Romeo and kills herself all because she wanted to escape to be with Romeo and not to marry Paris. I think the play is more than just a fight scene because it also offers the turning point in the play and also gives a reason for Romeo to be banished so he is in the right place for they deaths to happen at the end.

Porches owns 50. 73% of the voting rights in Volkswagen GAG. Besides selling its own sportscast, Porches also provides automotive financial services, engineering services and consultation services to other automobile companies. Porchs slogan There is no substitute demonstrates how proud they are about the exclusiveness of the brand. Currently, this company has more than 17,500 employees worldwide. The Marketing STEP Process, (Primp. 2013) The market segmentation, targeting and positioning (STEP) process is a way to define the market, create market segments, and select target customers which guide the company to develop and implement appropriate marketing mix. 1) Segmenting Consumer Markets Demographic segmentation divides the market into groups based on variables such as gender, age, income and geographical locations etc. Porches s a luxury automobile brand, its target customers are middle aged single male, mainly 35-55 years old with high average annual gross income: who are willing to spend money on high-ended and expensive consumer goods. Lately, Porches has extended its product line to the Sport Utility Vehicle (SUB) market which TA regrets the high income family group; as well as the luxury saloon/sedan targeting the business car market. Cryptographic segmentation which divides buyer into different groups based on social class, lifestyle and personality traits. Luxury sportscast are not daily necessities. People willing to ay for a Porches sportscast tend to use it as a tool to reflect their wealthy and superior social status. This is one of the reasons why Porches always advocates on its high quality engines, designs, engineering and assembled materials. 2) Target Marketing Target market consists of a set Of buyers who share common needs or characteristics that company decides to serve segmented by above criteria mentioned in 1). It is interesting that among the high-end sportscast brands, Porches has a very special pricing strategy. Porches Company is actually positioning itself in the high-end sportscast division, but selling its cars at a imperatively reasonable price among similar market players like: Ferreira, Mistreat, Budgets, Zoned and etc. These brands are offering even more expensive sports cars when compared with the Porches Company. The Marketing Mix, ups Marketing mix is the most flooded word in the marketing field and it is a useful tool to look at how a business is positioned to reap the benefits of marketing. A Marketing mix is mainly described by four units; including product, price, place and promotion. These units support each other and work together to maximize the benefits of Marketing. 1. Product Porches Company mainly focuses on providing specialized, high-end sports icicles. Product Variety Porches categorized its sportscast into several product lines as follow. Firstly, the Booster roadster series (the 91 1); the flagship model established its reputation in the Daytona Racing in the mid-sass and won major world championship sports car races. Product Durability It is reported that for 70% of the cars produced by Porches are now still inning on the road which means the German precise engineering provided an extra long running life. Besides, the Pre-owned cars selling in their official website shows Porches has 100% confidence on its used car. Product uniqueness In terms of automobile design, a OR (rear-engine, rear-wheel drive) layout is a very unique technique. It is very rare for car manufacturers to place the engine at the back of the car, but this unique design turns out to give a physically smaller, lighter, less complex and more efficient deteriorative. This unique deteriorative is a distinctive selling proposition for Porches sportscast to fraternity from its competitors as there are nearly no car manufacturer offering such kind of chassis design. 2. Price The price of a product is a large determinant of how the market responds to the product. The key factor affecting the pricing strategy of Porches is the production cost; the company will be forced to cover the cost in order to make revenue. Competition pricing Porches sets lower price for the products when compared with its direct competitors, this allows them to capture larger market share. The vehicle prices Of the Porches Company ranged from WHISKS,OHO to By offering sportscast with similar specifications, this is definitely a very compatible price range in the market. Even at a relatively lower price, Porches still guaranteed to provide top quality vehicles and maintain its elite market status. Premium Pricing The high product prices can already tell the exclusiveness of Porches products. Consumer generally believed that a premium priced product equals to high quality. It is easy to understand that a HECK$800,OHO European Porches sportscast must be better than a HECK$200,OHO Korean Handy car. 3. Place It refers to the channel of distribution, and how reachable it is to their customers. The intermediaries offer the manufacturer greater efficiency in making goods available to target markets. Distributorship Porches Company is a world wide automobile manufacturer, they sell cars all around the globe, include: North America, Latin America, Europe, Middle East, Africa, Asia and Australia. Just like most of the automobile company, Porches makes sales through local distributors. Until 2012, there are more than 900 distributors across the world offering Porches vehicles. Porches GAG CEO Matthias Mueller expressed that Maria Sharecrop is an exceptional athlete combining top performance in her sports with elegance and power which perfectly fits the mage of Porches. And the charming appearance of Sharecrop can definitely attract Porchs target customers middle aged male. Customer Based Brand Equity (Keller, 2003) As lenience Porches, the brand name itself already represents high performance sportscast, almost all civilized people in the world aware of this brand. However, people will not think of this brand very frequently because Porches vehicles are very high involvement products. It requires a very long consumption consideration period before making a purchase decision. Performance Comparing to its competitors, Porches is actually providing superb cars with lassie but fashionable design. Their sportscast satisfied all basic needs of customers with reliable and durable technical performance but at the same time with a comparatively lower price among its competitors. Besides, the Made in German represents high quality and precise. Judgments Considering its quality and credibility, Porches is well-known of its precise, excellent engineering and assembling techniques. Managing strategic change Essay Example | Topics and Well Written Essays - 2250 words

Managing strategic change - Essay Example In 2003 the system of tax credits for children and for adults was overhauled and extended, such that the meaning of means-testing has been substantially changed. The NHS Plan, published in 2000, finally produced a major cash injection for the service, the results of which did not begin to be felt until the end of 2001. Only after acting to redraw the work-welfare relationship to embody the ideas of opportunity and responsibility via the new instruments of the New Deals and tax credits did New Labour begin to justify vastly increased expenditure on health and education as necessary investments in human capital. It is also crucial to note that Labour Party leaders expressed caution about how much the state could actually do to achieve these ideas at the heart of its policy goals. In a speech on 'modernising central government' in 1998, Tony Blair said: 'Big government is dead. The days of tax and spend are gone. (www.new.bbc.co.uk) When people come together in groups, communities, cities or nations, levels of confusion and anxiety rise. Attempts are made to manage this anxiety by creating structure, rules and legislation. Organizations can be viewed as mini societies in which changes are driven or resisted in accordance with the beliefs that are deeply held by the members of that society. The beliefs may not be articulated explicitly. They may be conveyed symbolically, through such things as stories, myths, rituals and ceremonies. (Klein, 2003) Force field analysis was developed by Kurt Lewin. Force field analysis enables managers to identify the forces that are likely to restrain a particular change. Force field analysis is sometimes used with groups in order to structure an open discussion about what is blocking a change. Having identified the potential sources and levels of resistance, Lewin suggested that managers should act so as to reduce the restraining forces, rather than to intensify the forces driving the change. Lewin, like Newton, argued that to every action there was an equal and opposite reaction. Increasing the forces for change increases the forces resisting it. Overcoming resistance was characterized by Russell-Jones as a movement from defiance, through compliance to alliance. Central to the effectiveness of any approach to man-aging resistance is the quality of the relationships that managers develop with people in the organization. We look at conversational approaches to developing closer relationships wi th people. (Johnson & Scholes, 1999) Practical Force field analysis. Unfreeze current attitudes According to BBC report Mr Nicholson, who has worked in the NHS for 29 years, said some of the changes would be aimed at reducing the NHS deficit, which topped '500 million. But he added it was also about improving services by providing the best care in fewer centres, although he acknowledged this would mean patients travelling further for treatment. Undoubtedly there will be tough decisions to make over the next 12 months to reflect changing services. (www.new.bbc.co.uk) Move to a new level According to BBC report the NHS chief executive further said that there would be up to 60 reviews of hospitals in England. He said the changes could affect every region, and may lead to emergency, maternity and

SPECIFIC MORAL ISSUES (DEATH PENALTY) Essay Example | Topics and Well Written Essays - 1750 words

SPECIFIC MORAL ISSUES (DEATH PENALTY) - Essay Example In total, there have been approximately 345 executions within Massachusetts, including 26 convicted of witchcraft. Until 1951, murder in the first degree called for a mandatory punishment of death. In 1951, the law was changed to allow the jury the discretion to recommend against a death sentence after considering mitigating circumstances - in which case the sentence would be life imprisonment -unlessthe murder was committed in connection with a rape or attempted rape, in which case the death sentence was mandatory. In 1968, voters expressed disapproval with this trend in a non-binding referendum, voting 49 to 31 percent in support of continued use of the death penalty. During the 1970's and 80's, a series of judicial rulings eventually eliminated the death penalty altogether under Massachusetts law: In 1972, the US Supreme Court decision of Furman vs. Georgia, threw out Georgia's death penalty as cruel and unusual, citing the arbitrary and capricious manner in which it was administered, and leading to capital statutes throughout the country being overturned. For Massachusetts, this meant that the discretionary death penalty for murder was nullified, but the mandatory death penalty for rape-murder was left intact for the time being (Cf.Commonwealth v. Harrington, 1975). On October 28, 1980, the SJC ruled inDistrict Attorney for the Suffolk Dist. v. Watsonthat a new capital statute signed into law by Governor Edward King the previous November (c. 488, Acts of 1979) was unconstitutionally cruel for all the reasons laid out inO'Nealand their opinion of the proposed 1977 bill. On November 2, 1982, voters approved by referendum (54 to 35 percent) an amendment to Article 26. The amendment, Article 116of the Massachusetts Constitution, states that: No provision of the Constitution... shall be construed as prohibiting the imposition of the punishment of death. This completed the amendment process, which had been initiated in 1980 by legislators acted quickly to draft another new death penalty bill. On December 15, 1982, the House and Senate passed legislation providing for capital punishment for first-degree murder. The bill was signed into law (c. 554, Acts of 1982) a week later by Governor King and went into effect on January 1st. This 1982 statute was invalidated by the SJC on October 18, 1984 in the case ofCommonwealth v. Colon-Cruz. While the death penaltyper sewas no longer forbidden by the Constitution, this particular statute improperly encouraged defendants in murder cases to plead guilty rather than face a jury trial, thus avoiding the possibility of the death sentence, and violating the right against self-incrimination and the right to trial by jury. Massachusetts has remained without a valid death penalty law ever since. Subsequent attempts to reinstate the death penalty have failed: By the time of theColon-Cruzdecision, Michael Dukakis had become governor again. Throughout these two terms, a nearly evenly divided legislature never passed a bill - which the governor would have certainly vetoed. In 1991, William Weld became governor. He, and every governor since, argued for death
